' This is an application for the grant of bail on behalf of Mst. Sakina petitioner who stands arrested under section 10/13 of the Offence of Zina (Enforcement of Hudood) Ordinance, 1979, in a case registered at Police Station Kot Addu, vide F.I.R. No, 203, dated 27-4-1988.
2. According to prosecution the petitioner along with Nur Muhammad was seen committing Zina on the night between 26/27-4-1988 in the house of one Ghulam Hussain. On the same night a case was registered and she was challaned with other accused. Petitioner's bail plea had been declined by the lower Court, hence this application.
3. Admittedly the petitioner is in jail for the last about ten months and so far not a single prosecution witness has been examined. S.I. Bashir Hussain states that the report from Chemical Examiner regarding vaginal swa bs of the petitioner is still awaited. The petitioner is a woman, therefore, I feel inclined to allow this petition and direct that the petitioner be Teleased subject to her furnishing bail bonds in the sum of Rs,10,000 with one surety in the like amount to the satisfaction of Assistant Commissioner/Duty Magistrate, Multan as requested by learned counsel for the petitioner.
