ORDER

' Applicants Abdul Basit, Muhammad Aslam and Abdul Sattar who are detained in Crime No,78 of 1989, Police Station Mirpur Mathelo, under sections 393, 398, 452 and 109, P.P.C., applied for bail before learned Sessions Judge, Sukkur, but without success. They have now approached this Court with the same prayer.

2. I have heard Mr. Ziauddin Nasir, learned counsel for applicants and Mr. Shaukat H. Zubedi, learned AA.-G. For State.

3. Applicant Abdul Basit was caught immediately after the incident and he has made judicial confession before Mukhtiarkar and F.C.M. Ubaro, although long after his arrest. Faced with this evidence against him, the learned counsel for applicants has not pressed bail application in respect of applicants Abdul Basit. Bail is, therefore, refused to applicant Abdul Basit.

4. The case of applicants Muhammad Aslam and Abdul Sattar is almost identical to the case of Manzoor Elahi who was granted bail by me on 20-8-1989. The learned A.A.-G. Has, therefore, not opposed the bail application in respect of these two pplicants. For the reasons recorded by me in Criminal Bail Application iA No,574 of 1989, while granting bail to co-accused Manzoor Elahi, I allow bail to applicants Muhammad Aslam and Abdul Sattar in the sum of Rs,50,000 (Rupees I fifty thousand only) each with P.R . In the like amount to the satisfaction of Sessions Judge Sukkur.
