1. ' This is an application for bail on behalf of the applicant Zaheer Ahmed. The case against the applicant and Manzar Hussain under section 302134, P.P.C. Is pending in the Court of Vth Additional Sessions Judge, Karachi East.
2. ' Briefly the facts are that one Shabbir Hussain was murdered and Munawar Hussain went and lodged report on 11-3-1988 at Police Station Shahrahe Faisal, Karachi East. The police, during the investigation, found that Munawar Hussain and applicant Zaheer Ahmed were responsible for the murder and false report against unknown person was lodged by Munawar Hussain.
3. ' I have heard Mr. Javaid Haider Kazmi, Advocate for the applicant. It is contended by the learned counsel that there is only evidence of extra-judicial confession against the present applicant, Zaheer Ahmed and that Mashir of recovery had filed an affidavit. It is argued that the main part in the case is assigned to co-accused Munawar Hussain, therefore, the case is of further inquiry.
4. ' Mr. A.A. Muhammad Ali, learned A.-G. Has no objection to the grant of hail.
5. ' In view of the above circumstances, I am of the opinion that it is fit Lase for bail. The applicant is admitted to bail on furnishing one surety in the sum of Rs,50,000 with P.R. Bond in the like amount to the satisfaction of the trial Court. revisions by the competent authorities.
