Rrya Afrasiah Khan, J-Zafar alias Chandi has moved this petition under section 497/498 Cr.P.C, for bail fater arrest in a case registered against him and others under section 302/452/148/149 P.P.C with Police Station Saddar Gujranwala vide F.I.R. No. 161 dated 6.3.1987. The allegation is that Ali Ahmad armed with pistol, Tariq armed with gun, Zulfiqar and Zafar armed with sticks trespassed into the house of the complainant. The allegation against the petitioner is general in nature that he too inflicted injuries with his stick on the person of Muhammad Iqbal deceased. It has been brought to my notice that all the co-accused have been admitted to bail. The learned counsel submits that the principal accused Ali Ahmad who was armed with a pistol was granted bail by this Court vide order dated 4-4-1989.
The next contention is that the petitioner has been in jail for the last more than two years and that his trial has not commenced so far.

The learned Assistant Advocate General does not oppose the grant of bail to the petitioner on the ground that even the principal accused has been granted bail by this Court and that lesser role has been attributed to the petitioner in the F.I.R. In the circumstances of the case, I am of the view that this is a case of further inquiry inasmuch as the petitioner is in jail for the last more than two years and that his trial has not commenced as yet. Accordingly, the petitioner is admitted to bail in the sum of Rs.1,00000/- with two sureties each in the like amount to the satisfaction of A.C/Duty Magistrate Gujranwala.
