ORDER

' This is an application for grant of bail to Tariq Mehmood petitioner in a case under section 302/392/397/412, P.P.C. Registered at P.S. Ahmadpur East vide F.I.R. No, 113/88.

2. According to the F.I.R. The dead body of Abdul Ghafoor deceased was found in sand dunes in Chak On post-mortem examination, the doctor opined that the death was caused by strangulation. During investigation the police came to the conclusion that the deceased was done to death by Muhammad Ali and Javed co-accused.

' As far the petitioner, the police collected evidence that the car of the deceased was seen at his Dera.

3. Learned counsel for the petitioner submits that the petitioner did not participate in the murder and the stolen car of the deceased was not recovered from the petitioner. Learned counsel for the State has not controverted the learned counsel for the petitioner.

4. I have considered the matter. I find that there is no evidence of the participation of the petitioner in the murder of the deceased; that there is no evidence of the petitioner being a party to the murder of the deceased; the stolen car of the deceased was not recovered from him and the only evidence collected by the police during investigation is to the effect that the stolen' car of the deceased was seen at his Dera.

5. Without making expression of opinion lest it may prejudice the merits of the case, I feel that a case for grant of bail to the petitioner has been made out. So he will be released on furnishing bail bond in the sum of Rs,30,000 with one surety in the like amount to the satisfactin of A.C./Duty Magistrate, Bahawalpur.
