1. The accused had only processed the loan application and recommended the grant of loan on the basis of Agricultural Pass Book prepared by Rehmat Khan Patwari and duly signed by the Halqa Girdawar and the Naib Tehsildar. If there was any false entry therein the accused petitioner could not be expected to have known that. The pass-book was under section 4(3) of the Loans for Agricultural Purposes Act (XLII of 1973) in the nature of a title deed and the accused petitioner could validly act upon the same. On the tentative assessment of the evidence as available on the record, I am of the view that there are no reasonable grounds to believe that the accused petitioner has committed any scheduled offence. I, therefore, grant him bail in the sum of Rs. 2 lacs with one surety in the like amount to the satisfaction of the Registrar of this Court.
