1. ' Case of prosecution is that a fight had taken place on 2-3-1988 at 4-30 p.m. Between the parties one of whom are Chandia while the others are Bengalis on account of which two counter-F.I.Rs, have been filed one by the complainant party while the other by the accused party. The F.I.R. Filed by the accused party i,e, Bengalis is earlier in time and the injuries sustained by the complainant party were simple in nature according to the provisional medical certificate. However, according to final medical certificate injury No,1 on the person of injured Photo was declared to be grievous.
2. Accused, Rafiq, Lutafullah and Noor Muhammad had also received injuries at the hands of complainant party and it is alleged that their injuries are grievous. A special Medical Board has also been constituted on the application of Bengalis accused party. Since there are counter-cases and injuries of nearly similar nature have been sustained by either side it is yet to be seen as to which of the parties is aggressor. Under these circumstances I direct that the applicants be released on bail on furnishing surety and P.R. In the sum of Rs,30,000 each to the satisfaction of the trial Court.
