' This is a revision petition filed under Section 13 of the Consolidation of Holdings Ordinance, 1960 against the order dited 4-5-1987 of the Additional Commissioner (Cons.), D.G. Khan whereby the appeal of the petitioner was dismissed.
2. I have heard the parties. Learned counsel for the petitioners has stated that Kh. No,228/9 belonged to the petitioners since long. It was also allocated to them in consolidation. But the Collector without any justification withdrew this number from their khata and adjusted it in the wanda of the respondent. The petitioners had already been given less land than their entitlement and by way of amendments by the Collector, their entitlement had further been reduced. He has also stated that the entitlement of the respondent has been wrongly worked out by the Consolidation Authorities which has resulted into giving land in his entitlement to the respondent.
Learned counsel for the respondent has stated that he has no objection if the entitlement of both the parties is re-checked.
3. In view of the position stated above, I consider it fit to remand the case to the Collector (Cons.) with the direction that entitlement of both the parties should be worked out afresh giving an opportunity of hearing to the parties and if any deficiency of land is found in the khata of the petitioners it should be made up causing minimum dislocation. The revision petition is accepted accordingly partly.
