' The petitioners are accused of the commission of offence under section 354-A of the Pakistan Penal Code.
2. In support of this bail application, it is contended by the learned counsel for the petitioners that the modesty of the complainant was outraged not in public but in a house and hence section 354- A, P.P.C. Is not applicable. The perusal of the F.I.R. Shows that the complainant was dragged by the accused side into their house and there, she was given beating and during the scuffle, she became naked.
3. It is further submitted that in course of investigation, three of the co- accused namely Sher, Sarfraz and Zulfikar were found innocent by the police. The petitioners are behind the bars since July, 1988 and no progress towards the trial has yet taken place. The case of the petitioners is also of further inquiry and accordingly. I direct that the petitioners shall be released on hail, provided each of them furnishes security in the sum of Rs,25,000 (Rupees twenty-five thousand) with two sureties each in the like amount to the satisfaction of A.C./Duty Magistrate, Jhang.
