2. Mr. Ghulam Shabbir Dayo, Advocate at the outset stated that he has not yet been enrolled as an Advocate in the High Court and he may be granted permission in this matter as he has been appearing in the lower Court. Such permission is granted.
3.Granted subject to all just/except ions.
4. He argued that case against the applicant Nisar Ahmad and others has been registered under sections I408, 409, 465, 468 and 471, P.P.C. At Railway) Police Station, Sukkur.
It is contended by Mr. Ghulam Shabbir Davo, Advocate that co-accused I A have already been granted bail by the learned Special Judge, Anti-Corruption'', (Central), Karachi and they are the main accused. He further argued that applicant is a Clerk and has been exonerated in the Departmental Enquiry.
5. Mr. Zawar, Hussain Jafferi the learned A.-G. Has no objection to the grant of bail. He has argued that from the police papers, it is clear that some co-- accused have already been granted bail. In support of the contentions, Mr. Ghulam Shabbir Dayo, Advocate has produced a letter of Accounts Officer No.1, DA.O.'s Office, P.R., Sukkur which states as under:- "Your defence being satisfactory is hereby accepted and you are exonerated this letter is issued on 14-9-1985."
I am of the view that this case requires further enquiry. Applicant Nisar Ahmed is admitted to bail on furnishing one surety in the stun of Rs.50,000 and P.R. Bond in the like amount to the satisfaction of learned Sessions Judge, Sukkur.
