' Nazeer alias Jecra petitioner stands charged with the murder of Shaukat Ali deceased taking place on the night between 15/16-11-1988.
2. In the F.I.R. No details of the occurrence are mentioned and only about the death of Shaukat Ali deceased through violence by some unknown persons is mentioned. It was in the supplementary statement made by Muhammad Rafiq that a suspicion was raised against the petitioner.
3. There is no direct evidence in the case and the petitioner is sought to be linked with the case by the circumstantial evidence coming through the following pieces of evidence; extra-judicial confession by the petitioner before Muhammad Siddique and Muhammad Sharif on 25-11-1988.
Wajtakkar evidence given by Shaukat Ali and Faqir Muhammad and the last seen evidence furnished by Khadim Hussain on 22-11-1988. No incriminating recovery has been made from the petitioner.
4. Bail is sought on the grounds that the case is based on absolutely false allegations and the petitioner has been involved on account of suspicion only. He is not named in the F.I.R. And the extra-judicial confession was allegedly made 9 days after the occurrence. The Wajtakkar evidence was also collected 9 days after the occurrence. The last seen evidence was recorded 6 days after the occurrence. It is contended that none of the above circumstances is sufficient by itself to bring A home guilt to the petitioner. There was no point in the petitioner confessing his guilt when it was a blind murder and the petitioner's name had not been mentioned in the F.I.R., it is added.
5. Keeping in view the above circumstances, there do not appear to be reasonable grounds at this stage that the petitioner is guilty of the alleged offence.
' Accordingly, I admit him to bail in the sum of Rs,30,000 with two sureties in thej like amount to the satisfaction of A.C., Kasur.
