' The petitioner, Nazar Muhammad, has moved this Constitutional petition praying that opening of history sheet against him and keeping his name in the Surveillance Register may be declared without lawful authority and of no legal consequence.

2. Report in the case was summoned which has been submitted by the concerned S.H.O. It is conceded in the report that in case F.I.R. No, 53 dated 26-7-1971 under section 379/411, P.P.C. Police Station Ahmadnagar, the petitioner was convicted and sentenced to pay a fine of Rs,45 and in default to undergo twenty days' R.I. By the learned Tehsildar/Magistrate IInd Class, Wazirabad vide judgment, dated 31-12-1972. Learned counsel forcefully submitted that after 31-12-1972 the conduct of the petitioner remained highly peaceful and that he was never involved in any criminal case.

This contention of the learned counsel for the petitioner is conceded by Mr. S.M. Zubair, learned Additional Advocate-General. There is nothing on record to show that the petitioner violated the law after 31-12-1972. It appears that the petitioner has been loyal to law for the about sixteen years.

This argument has too been conceded by the learned Law Officer. In view of the above, this petition succeeds and is allowed. The result is that the impugned order of opening the history sheet against the petitioner is set aside. . revisions by the competent authorities.
