' Nawaz and Nazra petitioners have moved this petition for bail in a case registered against them under section 302/34, P.P.C. At Police Station Lundianwala on 10-6-1977. The case of the prosecution is that Mst. Maryam deceased was the wife of Allah Dad complainant. Four days prior to 10-6-1977 she fell out with the complainant and went to the house of her parents. On 10-6-1977 Allah Dad complainant heard alarm from the Dhari of his father-in-law and reached there. He found the dead body of Mst. Maryam deceased lying at the Dhari. Fa7il, Shahadat and Lal informed him that Nawaz and Nazra petitioners had committed her murder by causing her injuries with a hatchet and Phaura respectively. The motive for the offence was that Nawaz petitioner had a suspicion that the deceased was having illicit relations with one Allah Ditta M ashki.

The learned counsel for the petitioners contends that there are only three eye-witnesses, namely Fa7il, Shahadat and Lal and all of them have sworn affidavits to the effect that they had not witnessed the occurrence nor had informed anybody about it. He further submits that Allah Dad complainant has also sworn a similar affidavit.
3. The affidavit of Allah Dad complainant and those of the eye-witnesses have been placed on the record wherein the three eye-witnesses named in the F.I.R. Have stated that they had not seen the occurrence nor had informed any one about it. Similarly the complainant has stated that he simply saw the dead body of his wife and informed the police about it and that no one had informed A him about the occurrences. In the circumstances I feel that there are sufficient grounds for further enquiry into the guilt of the petitioners and they are entitled to the concession of bail.
Consequently, I admit them to bail in the sum of Rs,20,000 each with one surety each in the like amount to the satisfaction of Assistant Commissioner, Jaranwala.
