The allegation against the petitioner is that he had stolen a tape-recorder belonging to the complainant from his shop in Kamunki.

Precisely, the allegation is that during the night, the complainant was sleeping, when some disturbance awoke him and he and his neighbour saw that the lock of his shop had been broken and soon thereafter, the petitioner was seen coming out running. On checking, it was found that a tape-recorder belonging to the complainant and some ornaments were missing. In course of investigation, the tape-recorder was recovered from the petitioner on 26th of September, 1988.
While in respect of the ornaments, the complainant himself stated that the said ornaments had not been stolen and were found in the house. The challan has not yet been submitted and the petitioner is in judicial lock-up, since 26th of September, 1988. The petitioner is behind the bars for the last five months, therefore, I direct that he shall be released on bail provided he furnishes security in the sum of Rs.25,000 with one surety in the like amount to the satisfaction of A.C., Gujranwala.
