ORDER

' The petitioner Mr. Muhammad Nawaz Qasuri, an Advocate of this Court has filed this petition under section 561-A, Cr.P.C. Seeking abashment of the criminal proceedings launched against him through a private complaint filed by respondent Abdul Hamid.

2. The facts of the case as disclosed in the complaint are unfortunate and it will not be necessary for me to dilate upon them. This petition is pending in this Court for the last 16 years, therefore, no further proceedings could take place in the criminal Court. The parties have entered into protracted litigation in civil as well as criminal Courts.

3. During the course of arguments addressed by Messrs M. Rafiue Bajwa, and Birjis Nagi, Advocates, the learned counsel for the petitioner, Mr. M. Rafique Bajwa, sought permission to withdraw this petition on the condition that if a direction is issued by this Court for the expeditious conclusion of the trial. I appreciate the sentiments of Mr. M. Rafique Bajwa and therefore, I feel no hesitation to accept the proposal for adjudication of the controversy before this Court. In this view of the matter, I direct that this complaint shall immediately be sent to the Court of Assistant Commissioner (City), Lahore, who shall expeditiously proceed with the complaint. The Assistant Commissioner, City, is directed to conclude the trial of this complaint within a period of four months. The Assistant Commissioner, City, is further directed to send a fortnightly progress report about the trial to this Court.
