ORDER

' Petitioner seeks bail in the case registered against him and seven others under section 307/148/149, P.P.C. At Police Station Jalalpur Jattan, District Gujrat on 3-7-1988 for an occurrence said to have taken place on the same day.

2. According to F.I.R. The petitioner armed with a Sota accompanied by his co-accused armed with fire-arms and Sotas had launched attack on the complainant and inflicted 7 injuries, 2 of which were lacerated wounds, 3 contusions, one swelling on the left leg and a complaint of pain on the lumber region. His companion, who has been named as a witness was also caused 3 injuries, 2 of which were contusions and one lacerated wound. The injury which was noted as a swelling on the left leg, was later declared grievous on a fracture having been located vide X-ray.

3. All co-accused of the petitioner including the one armed with fire-arm, have already been released on bail. Although the grievous injury noted on the left leg of the complainant has been assigned to the petitioner specifically but according to the F.I.R. He was wielding a Sota only. He is in jail for about eight months. No witness has been examined in the trial so far.

' In the circumstances, a case for bail appears to have been made out. This petition is therefore, allowed and the petitioner is directed to be released on bail, provided he furnishes bail bond in the sum of Rs, twenty thousand with one surety in the like amount to the satisfaction of the Assistant Commissioner, Gujrat.
