' Muhammad Latif petitioner and his son stand charged for the murder of Muhammad Sarwar deceased. The occurrence is alleged to have taken place on 18-8-1988.
2. The prosecution case is that both the accused had gone to the cattle-shed of the deceased and on the Lalkara of the petitioner his son Ishaque fired a gun shot at him which proved fatal.
' The motive for the offence was that a day prior to the occurrence Muhammad Sarwar deceased had picked up an altercation with the accused over the draining out of water and assaulted them.
3. Bail is pleaded on the grounds that only a proverbial Lalkara is attributed to the petitioner and he is not alleged to have fired any shot at the deceased or caused him any injury. No recovery was effected from him. In the report under section 173, Cr.P.C. The police had mentioned that his involvement was doubtful.
' As, except for Lalkara, no overt act is attributed to the petitioner, I admit him to bail in the sum of Rs,50,000 with two sureties in the like amount to the satisfaction of A.C., Sheikhupura.
