ORDER

' The petitioners seek bail in a case registered against them and four others under section 148/307/149, P.P.C. On 24-9-1988 at Police Station Wandat Colony, Lahore, on the statement of Rehmat Ali.

2. According to the F.I.R., both the petitioners had given one blow each on the head of Muhammad Yousaf with a brick. Certified copy of the medico-legal report produced by the learned counsel for the petitioners shows that Muhammad Yousaf had suffered two injuries, one lacerated wound 4 c.m. x 0.5 c.m. x 0.5 c.m. On the left top of skull and the other 1.5 c.m. x 0.4 c.m. x 0.4 c.m. On the dorsal aspect of left big toe. The injury found on the head of Muhammad Yousaf does not appear to be the result of two brick blows. The medical evidence thus is contradictory to the account given in the F.I.R. The injury found on the toe of Muhammad Yousaf has not been explained in the F.I.R. In that also, there is contradiction. The co-accused of the petitioners have already been allowed bail.

They are in jail since more than two and a half months.

3. In the circumstances, I am of the view that a case for bail stands made out. This petition is, therefore, allowed and the petitioners are directed to be released on bail on their furnishing bail bonds each in the sum of R s.15,000, with two sureties each in the like amount, to the satisfaction of Assistant Commissioner/Trial Court, Model Town, Lahore. revisions by the competent authorities.
