ORDER

' Muhammad Jamil petitioner along with 3 others stands charged for an offence under section 365/420, P.P.C. It is alleged that on 19-1-1988 a person came to the shop of Malik Ishfaq Ahmad and Muhammad Yousaf P.Ws. And took the latter alone on the ground of getting some decoration work done in his house. They both went in the car of Muhammad Yousaf victim. Later the accused got a Ruqqa scribed from Muhammad Yousaf addressed to his wife asking her to deliver his T.V. And V.C.R. To the bearer.

' It is alleged that the accused had secretly confined Muhammad Yousaf in their house. He managed to throw a Ruqqa in the adjoining house narrating the position. Later when the accused were taking Muhammad Yousaf on a motorcycle he jumped down and appeared before the police who got him medically examined. Twelve injuries were found on his person.

The petitioner was arrested on 12-4-1988 and on 19-4-1988 the car belonging to Muhammad Yousaf P.W. Was recovered from his house.

2. It is contended that the case is based on false allegations and does not fall within the prohibitory clause of section 497(1), Cr.P.C.

3. Learned counsel for the State has opposed the bail. According to him the petitioner has a criminal history and is involved in five criminal cases.

4. Since the petitioner is named in the statement of Muhammad Yousaf P.W. And his car was also recovered from his house, I do not consider him entitled to bail and accordingly dismiss the petition.
