' Muhammad Btita petitioner has moved this petition for bail in a case registered against him and others under sections 148, 302, 307 and 452/149, P.P.C. His co-accused Khan, Nazir and Bashir have moved Criminal Miscellaneous No, 2987-B of 1988 for bail in the same case. Both the petitions are being disposed of by this order.
2. The F.I.R. Version of the occurrence is that on 1st June, 1988 the petitioners armed with Sotas and their co-accused Rafiq armed with an iron rod trespassed into the house of Javed complainant and caused injuries to his father Muhammad Sadiq and brother Muhammad Mansha. Co-accused Rafiq and Bashir petitioner allegedly gave one blow each with their respective weapons on the head of Muhammad Sadiq deceased while Nazir gave him a Sota blow on the left eye. Buta petitioner gave a Sota blow on the head of Muhammad Mansha, and Khan Muhammad gave him blows hitting his shoulders and chest. Then Buta petitioner gave him more blows. On hearing the alarm Altaf and Muhammad Yusuf P.Ws. Alongwith other persons reached the spot and rescued the injured from the accused persons. Later on, Muhammad Sadiq died in the General Hospital, Lahore. The case was registered on 4th June, 1988 at the instance of Javed complainant.
3. Learned counsel for the petitioners contends that all the injuries on the person of Mansha P.W.
Have been declared simple in nature and the medical evidence does not support the F.I.R. Version so far as the injuries of Muhammad Sadiq deceased are concerned.
' The learned counsel for the complainant has opposed the prayer for bail. The learned State counsel, however, does not oppose the prayer on behalf of Buta and Khan petitioners who are alleged to have caused simple injuries to Muhammad Mansha P.W. About the remaining two petitioners, namely Nazir and Bashir, he submits that the part attributed to them finds support from the post-mortem report, therefore, no ground for the grant of bail in their case is made out.
4. 1 have considered the submissions made by the learned counsel for the parties in the light of material available on the record. Khan and Buta petitioners are not alleged to have caused any injury to the deceased. The only allegation I against them is that they caused simple injuries to Muhammad Mansha P.W. In the circumstances, interim bail allowed to Buta petitioner vide order dated 4-9- A 1988 is confirmed while Khan petitioner is admitted to bail in the sum of Rs,20,000 with one surety in the like amount to the satisfaction of Deputy 1 Registrar (Judicial) of this Court.
' Nazir and Bashir petitioners gave Sota blows to Muhammad Sadiq deceased hitting his head and left eye. The post-mortem report shows that the I deceased had two injuries on the head and one on the left upper eye-lid. No I ground for their bail is made out at this stage. Their petition is dismissed.
