' This criminal appeal arises from the judgment of the learned Sessions Judge, Bahawalpur, whereby he on 23-12-1987 convicted Muhammad Bilal under section 377, P.P.C. And sentenced him to 5 years' R.I. And fine of Rs,10,000 in default 2 years' R.I.

2. Learned counsel for the appellant has not challenged conviction of the appellant under section 377, P.P.C. He states that there is ample reliable evidence in proof of the commission of crime by the appellant. He has requested for reduction in the sentence. Learned counsel for the State has opposed this prayer.

3. I have considered the matter with care. I feel persuaded to agree with the learned counsel for the appellant. The sentence of 5 years' R.I. Is, therefore, reduced to 4 years' R.I. And fine of Rs,10,000 is reduced to 5,000 or in default 1 year's R.I. He will get the benefit of provisions of 382-B, Cr.P.C. As directed by Court.

4. With this modification in the sentence, the appeal is dismissed. The fine, if recovered, the whole of it will be paid to the complainant. .
