' This a petition under section 497/498, Cr.P.C., by Mst. Ghulam Fatima, petitioner, for bail in respect of a case arising out of F.I.R. Lodged by one Mori Khan at Police Sation Bhaira in respect of an unwitnessed murder of his father-in-law, Muhammad Hayat, deceased, on the night between 8-9- 1986.
2. The bail is pressed on the statutory ground that though more than two years have passed by since the petitioner was arrested, her trial has not concluded.
3. Arguments heard. The petitioner was arrested on 13-7-1986. It appears that after the trial began, only one adjournment was taken on behalf of the petitioner, which entailed a delay of about a month and a half. Only three formal witnesses have been examined. The material witnesses yet remain to be examined. Due to the election, the trial is likely to be delayed. The petitioner has made out a case for her release on bail.
4. For the foregoing reasons, this petition is accepted and Mst. Ghulam Fatima, petitioner, is released on bail, subject to her furnishing security in the sum of Rupees fifty thousand (Rs,50,000) with two sureties each in the like amount to the satisfaction of the trial Judge.
