This order will dispose of aforetitled Petition C.M. 359/89 alongwith Writ Petition No. 346/1989 and Cr. Org. No.7/1989.
2. Petitioners' grievance is that respondent No.1 calls her father who was convicted and sentenced to death by Courts and was hanged, as "Shaheed" and has thus committed contempt of Courts, disqualified herself under Article 63 (1) (g) of the Constitution and has also violated injunctions of Islam.
3. The premise whether one is "Shaheed" or not is a matter which Allah alone knows and decides; temporal Courts have no jurisdiction to determine such a question. So was the submission of Mr. Rashid Murtaza Oureshi, Advocate who presented an application to he impleaded as a party m the titled petition.
4. For the foregoing reasons, these, petitions cannot be entertained by this C.M. 1/89 Muhammad Ismail Chaudhri for Petitioner.
