ORDER

' This is an application for bail on behalf of Imam Bux alias Imamun petitioner in a case under section 16/11 of the Offence of Zina (Enforcement of Hudood) Ordinance, 1979 registered at P.S. Zahirpir, vide F.I.R. No. 154/84, dated 14-7-1984.

2. The prosecution case is that the co-accused abducted Mst. Shamim in order to subject her to illicit intercourse and that on the way, the petitioner gave Rs.700 to Yasin co-accused and provided vail to Mst. Shamim and at the same time asked the co-accused to take her away and bring her back after her Nikah.

3. The learned counsel for the petitioner submits that the petitioner is an old man of about 58 years and has falsely been involved in the case because of his son Yasin co-accused.

' The learned counsel for the State has, however, opposed this application.

4. I have considered the arguments advanced by the learned counsel for the parties with care. I find (as stated by the Sub-Inspector) that the petitioner is an old man of about 60 years; that there are no allegations of Zina against him; that his son Yasin is also involved in the case and that the allegations against him are that he provided vail to Mst. Shamim, the abductee and gave Rs.700 to Yasin and asked him to bring her back after her Nikah.

5. For what has been found above, I am of the view that it is a fit case for grant of bail to the petitioner. He shall be released on furnishing bail bond in the sum of Rs.10,000 with one surety in the like amount to the satisfaction of A.C./Duty Magistrate, Khanpur.
