ORDER

' Liaquat All son of Muhammad Ismail petitioner seeks bail in a case pertaining to the murders of Sardar All and Siraj Din Machhi and for murderously assaulting Azra Bibi, Ghulam Nabi and Mst.

Ruqqia Bibi on the night of 30-7-1988 with fire-arms.

The motive for the offence was that one Hameed Faqir (since dead) had abducted the daughter of Roshan Faqir which was got restored to Roshan Faqir by Sardar All deceased to the annoyance of Hameed Faqir, etc. Who had threatened him in this behalf. Besides Liaquat Ali son of Muhammad Ismail petitioner, Shaukat, Habib, Anwar, Paryal alias Paroo and Shaukat Ali son of Fazal Din are also charged for the offence in question which was allegedly committed in conspiracy with Muhammad Din and Liaquat All son of Muhammad Shafi.

3. Bail for Liaquat All son of Muhammad Ismail petitioner is urged on the grounds that he is not named in the F.I.R. And that he is in no way connected with the motive or other accused. He is not alleged to have caused any injury to the deceased or any of the injured P.Ws. Only ineffective firing is attributed to him by Ruqqia Bibi and Javaid Iqbal P.Ws. Who were examined after the F.I.R. Had been recorded. No recovery is said to have been effected from him.

4. In view of the above circumstances the petitioner is considered entitled to bail. Accordingly, he is admitted to bail in the sum of Rs, one lac with two sureties in the like amount to the satisfaction of A.C., Kasur.
