Ayub son of Ghulam Muhammad was convicted alongwith his co-accused for offences under section 302/307/148/149, P.P.C. The petitioner was, however, found guilty under section 326, P.P.C.
And sentenced to 5 years' R.I. And! a fine of Rs,5,000 or in default six months' R.I. He was also given the benefit of] section 382-B, Cr.P.C. Learned counsel for the petitioner submits that the! Petitioner has been in jail since June, 1985 and had already undergone more than 3-1/2 years of his sentence.
Contends that there is no likelihood of the appeal being heard in the near future and it is just possible that by the time when the appeal comes up for hearing he has already undergone the entire period of his sentence.
2. In these circumstances, the sentence of the petitioner is suspended provided he furnishes security in the sum of Rs,20,000 with two sureties each in the like amount to the satisfaction of Assistant Commissioner/Duty Magistrate, Faisalabad.
