1. AJMAL MIAN, C.J.--The applicant, who is facing trial under section 420/467/468/471, P.P.C. In Crime No. 254/86 alongwith certain other co-accused for allegedly misappropriating the pension amount of Rs.4,50,398.63 had applied for bail before the learned Presiding Officer Special Court (Offences in Banks) Karachi. Originally the applicant was arrested in 1986 after the filing of the complaint by F.I.A.
2. But he was admitted to bail by the learned Sessions Judge, Jacobabad, in 1982. Thereafter, he was arrested again on 4-3-1989 and since then he is in custody. The learned Presiding Officer has not decided the applicant's application for bail which he had filed.

In our view, it will be appropriate to direct the learned Presiding Officer, Special Court (Offences in Banks) Karachi to decide the application on merits within a period of one month-from the date of the receipt of a copy of this order as more than 2 years have passed from the date of filing of the original complaint, the Investigation Agency must have collected some material against the applicant.
3. With the above observation, the application is dismissed.
