' This is an application for the suspension of execution of sentence of Faiz Muhammad, Hamid, Ghulam Hussain alias Hussaina, Suleman and Tagl ia petitioners who stand convicted under sections 307 and 148, P.P.C. And sentenced as under:-
(i) Under section 307, P.P.C. To five years' R.I. And fine of Rs,5,000 each;
(ii) Under section 148, P.P.C. To one year's R.I. With the direction that the sentences will run concurrently.
2. Learned counsel for the petitioners submitted that the injuries allegedly caused by the petitioners to Allah Bukhsh P.W. Being simple no offence punishable under section 307, P.P.C. Was committed by them. The learned AA.-G. While conceding that the injuries caused by the petitioners to Allah Bukhsh were simple, has opposed this application on the ground that the petitioners have been sentenced to five years' R.I.
3. I have considered the submissions made by the learned counsel for the parties with care. I find that it is very much obvious from the judgment that the injuries allegedly caused by the petitioners were simple; that being the position, the question of application of section 307, P.P.C. Needs serious consideration.
4. For what has been said above, the petitioners are allowed bail in the sum of Rs,10,000 each with one surety each in the like amount to the satisfaction of A.C./Duty Magistrate, Taunsa Shard.
