1. ' By Order dated 11-11-1988 the case was adjourned to enable the parties to explore the possibility of settling the dispute outside the Court. Mr. Abaidullah, General Manager of the respondent-bank has prepared various statements of salaries for the relevant period. Let his statement be recorded.
2. ' Statement of Mr. Abaidullah, General Manager, Punjab Provincial Cooperative Bank Ltd., The Mall, Lahore on SA.
3. ' The bank made an offer to the petitioner for re-employment by its letter dated 2-4-1984 according to which he was entitled to back benefits from 14-10-1982 but not to conveyance and other benefits like bonus and leave salary (Exh. R/1.). The petitioner did not accept the offer. The bank is now prepared to pay to the petitioner Rs,78,000 in full and final settlement of his previous salary (Exh.R/1-A). The bank is also prepared to re-employ him from the date he joins, as new entrant. The gratuity and pension admissible to the petitioner on the basis of service already served before dismissal of his appeal by the Supreme Court and subsequently will be decided by the bank in accordance with the relevant Service Rules. This will be without prejudice to the demand raised by the petitioner in his application dated 2-8-1986 (Exh. R.2). His application will be placed before the Board of Directors of the respondent-bank in its next meeting scheduled to be held in next December for consideration. The petitioner will be afforded an opportunity of being heard by the Board or the sub-committee constituted by the Board before any decision is taken against him. The amount as per that application comes to Rs,2,14,115, without bonus and with bonus Rs,2,54,597. The statement is produced as Exh. R.3.
4. Statement of Faiz Ahmad son of Ch. Sardar Muhammad, resident of House No, 26, Ishwar Street 82, Islampura, Lahore on S.A.
5. ' I have heard the statement of Mr. Abaidullah, General Manager of the respondent-bank. I accept the offer made by him. The writ petition be decided in the light of the offer made by the General Manager which is acceptable to me. ORDER The parties have arrived at a compromise. The writ petition is, therefore, accepted in the light of the aforesaid statements which shall be read as part of this order. There shall, however, be no order as to costs.
