' Through this Constitutional petition Ali Gohar petitioner wants this Court to direct S.H.O. Police Station, Jauharabad, respondent No,1 to register case under section 365/307/342/364/452/506/149, P.P.C. Against Fateh Sher and 7 others, respondents. Nos. 2 to 9.
2. S.H.O. Police Station Jauharabad states that the application of the petitioner for action against Fateh Sher and others, was inquired into by him under the orders of the D.S.P. And was found false.
He has produced copy of the report entered by him in the Roznamcha in this respect. Learned counsel for the petitioner submits that the inquiry was conducted without associating the petitioner and giving him an opportunity to produce witnesses in proof of the charges. He argued that since Fateh Sher and others had committed cognizable offences, so the police should have registered the case first.
3. I have considered the submission made by the learned counsel with care. In the circumstances that the allegations levelled by the petitioner against Fateh Sher and others have already been inquired into by the police and in this respect a report has already been entered in the Roznamcha, I do not feel inclined to direct the police to register case. The petitioner may file complaint, if so advised.
' For what has been said above, I do not see any justification to exercise the Constitutional jurisdiction of this Court in the aid of the petitioner, so the petition is dismissed. .
