1. ' AJMAL MIAN, J.-- The case has been called out several times since morning but nobody has turned up for the appellant. It is now 10-20 a.m. Mr. Abdul Waheed Siddiqui for the State. Mr. S. Nasiruddin for the private respondent.

We have gone through the order under appeal and it appears that the learned trial Court has given cogent reasons for recording the acquittal order namely, that there were only two alleged eye-witnesses, it was held that the presence of P.W. Barkat Hussain at the relevant time at the place of incident was unbelievable as he was resident of a place 3 miles away from the place of incident which fact he admitted in his cross-examination.
2. ' With regard to P.W. Haji Manzoor, the learned trial Court has pointed out that he has admitted that he and the complainant Abdul Razzak are caste-fellows and they are originally residents of Rawalpindi. There were delay in lodging of the private complaint in question by about a month.
3. There seems to be no case for interference in Acquittal Appeal on the basis of the state of evidence on record. Mr. Abdul Waheed Siddiqui, learned counsel for the State, has also urged that the order under appeal is in consonance with law as there was no reliable evidence to record conviction in a murder case.
4. ' We would, therefore, dismiss the above Criminal Acquittal Appeal. revisions by the competent authorities. Therefore, it is advisable to consult the official sources or legal professionals for the most up-to-date and accurate information.
