' Vide F.I.R. No, 129 dated 10-6-1986 lodged at 6-15 hours about an occurrence of 5-30 hours Muhammad Yusuf accused petitioner, alongwith his son Amjad, one Abdul Malik and two unidentified persons were reported present standing near the cattleshed on fire and where the complainant raised alarm, Ali Akbar, Muhammad Afsar and the womenfolk came out of their houses and extinguished. The complainant charged the accused for having put cattleshed on fire by sprinkling oh (kerosine). One Sharafat reported to be present who has witnessed the accused, Ali Akbar the eye-witness cited in the F.I.R. Did not state to have seen the accused party present and he further stated that even Sharafat was not present at the time and place of occurrence.

He was released on bail by the Magistrate but the learned Session Judge recalled his bail for he was previously charged for the offence under section 506/34, P.P.C. The other two unidentified persons have not been traced as yet. In the circumstances, I would release the accused-petitioner on bail in the bond of Rs, 10,000 with two sureties for the like amount each, to the satisfaction of the Ilaqa/Duty Magistrate. revisions by the competent authorities.
