ORDER

Muhammad Akhtar petitioner is stated to have taken Mst. Shahida Parveen a minor girl of six years age to a nearby field for committing Zina with her. He allegedly had put off his Shalwar and also stripped Mst. Shahida Parveen naked and was attempting to commit rape with her, when the P.Ws.

Reached there and on seeing them he decamped. The F.I.R. Was lodged, the same day, at Police Station Zahir Pir, by the father of the girl. The petitioner was arrested and challaned. The petitioner applied for the grant of bail in the lower Court but remained unsuccessful, hence the instant petition.

2. I have heard the learned counsel for the petitioner as well as for the State and perused the record.

3. Admittedly no marks of violence were found on the private part or other parts of the body of Mst.

Shahida Parveen. The petitioner is in jail for a few months. The challan is stated to be ready. He is 15/16 years of age. The allegation is only about attempt to commit Zina, therefore, I feel inclined to allow this petition. The petitioner is directed to be released on bail subject to his furnishing bail bond in the sum of Rs.10,000 with one surety in the like amount to the satisfaction of Assistant Commissioner/Duty Magistrate, Rahim Yar Khan. revisions by the competent authorities.
