1. Accused-petitioner was arrested on 24-3-1986 in some other case when he had allegedly made a confession of removing .30 bore pistol from Parvez Khan, Sub-Inspector busy in performing duty and that he had later on sold the said pistol along his co-accused Abdul Ghaffar in Dara Adam Khel. Thereafter, his separate confession was recorded on 17-4-1986 in this case. Accused- petitioner has since retracted from his confessions one made after 8 days and the other after 24 days. His co-accused has since been released on bail. Case is not apparently covered by Hadd.
2. The pistol stolen was sold for Rs.2,500. In the circumstances, the accused-petitioner is granted a bail on furnishing bail bond in the sum of Rs.20,000 with two sureties to the satisfaction of the Ilaqa/Duty Magistrate.
