1. ' Javed alias Jaida alias Pervaiz alias Paiji son of Noora Bhatti resident of Dhoke Kashmirian, Rawalpindi is one of the accused in a case registered on 7-5-1987, at Police Station Waris Khan Rawalpindi under section 10/16 of the Offence of Zina (Enforcement of Hudood) Ordinance, 1979.
2. ' I do not think it is necessary to discuss the facts in detail because the allegation against the petitioner is that it was from his house that Mst. Bashiran was recovered..
3. ' Learned counsel laid great stress on the fact that nowhere Mat. Bashiran stated that the petitioner had sexual intercourse with her.
4. ' The A.A.-G. Has not been able to controvert this position.
5. ' In the absence of any allegation regarding sexual intercourse I do not find any justification to keep the petitioner behind the bars. He is accordingly admitted to bail in the sum of Rs,20,000/- (Rupees twenty thousand) with one surety in the like amount to the satisfaction of A.C. City Rawalpindi.
