Hasnat petitioner and his maternal-cousin Zaka Ullah are accused of the murder of Mst. Maroof wife of the petitioner. The case was registered against them at Police Station Hafizabad on 6-12- 1985.
2. Zaka Ullah accused was allowed bail by me on 12-10-1986 in re: Criminal Miscellaneous No. 2591- B/86. Since facts of the case have been enumerated in that order, it may be read as a part of this order.
3. Petitioner's case is pressed on the ground of having acted under grave and sudden provocation without prejudice to the case of either side, there are circumstances appearing in the allegation itself which lend support to the submission. The petitioner is in jail since December, 1985. He is allowed bail in the sum of Rs.25,000 (Rupees twenty-five thousand) with two sureties each in the like amount to the satisfaction of A.C./Duty Magistrate, Hafizabad.
