ORDER

This is a petition for suspension of sentence on behalf of Ghulam Mustafa petitioner who has been sentenced to imprisonment for life and a fine of Rs.1,000 a/s 302, P.P.C. And R.I. For three years and a fine of Rs.500 a/s 307, P.P.C. With the direction that both the sentences shall run concurrently.

2. Bail is claimed on the ground that the appeal of the petitioner having not been decided within a period of two years of his conviction, he has earned the right of bail. Learned State counsel has opposed the prayer for bail.

3. The petitioner was convicted vide judgment. Dated 7th July, 1985. His appeal has not been decided within a period of two years of his conviction, and the case falls under clause (c) of subsection (IA) of section 426 of the Cr.P.C. I, therefore, suspend his sentence subject to his furnishing security in the sum of Rupees one lac with two sureties in the like amount to the satisfaction of A. C . Sahiwal.
