1. Mazharul Haq, J.-George Masih and Mansha Masih along with four others are accused of rape on Mst, Sughran. A ease under sections 10/11 of the offence of Zina (Enforcement of Hudood)

2. Ordinance VII of 1979, was registered against them at Police Station All pur Chatta on 20-5-1986.

7. The prosecutrix is 17 years of age. She made the FIR seven days after the occurrence and appeared before the police of her own. She alleged that she had been raped by Atum, Siddiq, Mancha Masih and George Masih. During the investigation, it transpired that in the first investigation, all were declared innocent. Later in the second investigation, Mst. Hafeezan. Mst.

3. Kishwar and Ameen were declared innocent. The narration in the FIR leaves the impression that she left the house of her parents of her own free will. Muhammad Younus, ASI, the investigating officio on going through the police file has stated that the parents of Mst. Sughran have not made any statement under section 161 Cr. P C. The ASI has admitted that they are alive. The challan issued to have been submitted in court but the chemical examiner's report has not been received so far. In view of these circumstances, petitioners are allowed bail in the sum of Rs. 5,000 each with two sureties each in the like amount to the satisfaction of A. C/Duty Magistrate, Gujranwala, pending trial.
