1. S. ABDUL JABBAR KHAN (CHAIRMAN).--In case of Ch.Rafique Ahmad Shad a miscellaneous application was filed by him in which he prayed that consequential relief as ordered by this Tribunal may be grated. This issue became controversial of law and correspondence was made and ultimately Government issued order in favour of the petitioner in which consequential relief were incorporated as relief pertaining to Grade-19. However, the competent authority (PRTB) on receipt of the said order of the Government moved back to Government pointing out certain flaws and its own point of view with the request that final determination may be done on this case to conclude the issue. The Government after consulting the Law Department Punjab withdrew the earlier order and thus the petitioner has not been granted the relief which he wanted i.e. Benefits of Grade-19 among others.
2. Learned counsel for the respondents has taken a stand that as far as the competent authority is concerned it is bound by the said order and as far as revised order they cannot delete the same.
3. According tohim if the petitioner is aggrieved it is for him to challenge the same before proper forum and get a relief.
4. On the other hand learned counsel for the petitioner has submitted that despite this order there are so many orders of Government in the field and this Tribunal should decide this case itself taking into consideration of said orders.
5. We are afraid and cannot accept this plea of the learned counsel for the petitioner as the relevant order will be this order which was first issued and then rescinded. In view of this we dispose of the petition as without merit and direct the petitioner to seek remedy, if any available to him before proper forum against the order of Government, if he is of the opinion that the same was not justified.
