Through this Constitutional Petition Anjum Zia petitioner seeks the registration of a case against Zafar Iqbal, S.I. And Saeed Gul, D.S.P. For wrongful confinement. According to him he was wrongfully confined in the premises of P.S. Model Town from 23-12-1984 to 27-12-1984. It is further stated that a preliminary inquiry was held into the matter by D.S.P., Cantt. Who found the allegation of illegal detention to be proved, against S.I. Zafar Iqbal and accordingly departmental proceedings have been initiated against the aforementioned S.I. The petitioner requests that since the illegal detention constitutes independent offence, a case may also be ordered to be registered against Zafar Iqbal, S.I. And Saeed Gul, D.S.P.
2. As Zafar Iqbal, S.I. Has been found to be prima facie guilty in the departmental inquiry, I grant the petition to his extent and order registration of a case against him for wrongful detention of the petitioner. The petition stands disposed of with the above observation.
Since the main petition has been disposed of, there is no need of passing any formal order on Civil Miscellaneous No. 1652 of 1986.
The petitioner may seek his remedy by filing a separate petition, if he so desires.
