' The Administrator, Thal Development Authority filed the present regular second appeal against Muhammad Khan Niazi, respondent to challenge the judgment and decree dated 29-7-1971 whereby the respondent was held entitled to hold and retain 154 Kanals and 14 arias out of suit land and thus accepting the appeal granted the decree for possession respecting the land to the extent mentioned above.

The memo, of appeal filed on 11-2-1972 as did not accompany he copy of memo of grounds of appeal of first appellate Court and copy of the judgment of the trial Court, the same was, therefore, returned by the office for re-filing the same alongwith above mentioned exquisite documents. -The memo. Of appeal was again filed on 6-7-1972. He certified copies of memo of grounds of appeal of the first appellate court and judgment of trial Court show that the same were applied r on 22-6- 1972 and were received on 30-6-1972. The appeal filed on the July, 1972, obviously is barred by time.
No reasonable explanation as been offered for not obtaining the copies of the memo. Of grounds f first appeal and judgment of trial Court before filing this appeal and then for not filing the second appeal immediately after receiving case two copies on 30-6-1972. The delay in filing the appeal, as such, cannot be condoned. The appeal is, therefore, dismissed as heard by time with costs. revisions by the competent authorities.
