ORDER

1. Through this application under section 10 of the Industrial Relations Ordinance, 1969, the Registrar of Trade Unions wants me to cancel the registration of the, respondent-Union on the ground that they did not submit the Annual Return of 1969. A notice of the application was served on the respondent Atta Muhammad, General Secretary of the Union who is present in Court. He has submitted his reply. His case is that after the imposition of Martial Law in 1969. Trade Unions activities were ` banned and hence his Union was not in existence, and that a Union styled as Elite Textile Workers' Union is functioning now. He, however, prays that his Union be allowed to continue and Its lapse condoned on that if any emergency arises, his Union is able to fulfil its obligations.

2. It is admitted that the returns for the year, 1969 were not filed before April 1969. It also transpires that the returns of the subsequent years were also not filed: In the circumstances; the registration of the Union must be cancelled and I accordingly direct the registrar, Trade Union to cancel the registration.
