' This is a revision petition against the order, dated 16-3-1970 passed by the Additional Commissioner, Hyderabad under section 67 of the Sind Irrigation Act, 1879, whereby he accepted the petitioner's appeal and reduced the fine to Rs, 5 per Acre for unauthorised use of watercourse RD-23.5-Hassan Ali Minor during Kharif 1966-67.
2. The impugned order has been passed under section 67 of the Sind Irrigation Act, 1879, according to which the order passed by the Commissioner is final and conclusive. There is no provision for revision to the Board of Revenue in the Sind Irrigation Act. As already held by me, vide my order, dated 24-3-71 in R.
0. R. No, 2527/68-69. Attar Khan v. Kadir Bux, District Khairpur, the Board of Revenue, cannot interfere in the matter under section 4 of the West Pakistan Board of Revenue Act, 1957, in view of tbe P L D1965 SC 314 and also cannot hear the revision petition under section 164 of the West Pakistan Land Revenue Act, 1967, after repeal of sections 203 and 211 of the Sind Land Revenue Code, 1879.
The counsel for the petitioner has conceded to this position.
3. In view of above facts, the Board of Revenue has no jurisdiction in the matter and the revision petition is therefore, dismissed accordingly. revisions by the competent authorities.
