In case of Muhammad Khalil, Inspector Cooperative Societies, the learned counsel for the appellant has argued this case at length and has submitted that the observation of the Promotion Committee by which the appellant was ignored was not based on facts as he stood exonerated from all adverse entries recorded against the appellant in the A.C.R. We find that vide order, dated 3-1-1980 which is in favour of the appellant passed by the Deputy Registrar Cooperative Societies, expunged all the adverse remarks given during the years 1973, 1974 1975 and 1976. The learned counsel for the appellant has addressed us on the legal issue involved in this case vide our earlier order, dated 6-3-1985 and has submitted that according to law laid down as long as the representation against the adverse remarks was pending, was not decided, the appellant could not be ignored for promotion. We have no dispute with the same.
2. We hereby direct the respondents (Registrar, Cooperative Societies, Punjab) to place the appellant at a proper place in accordance with the rule and law in the seniority list of 1984. The appeal is disposed of accordingly.
