' This is a revision petition against the order, dated 31-7-1983, passed by the Additional Commissioner, Hyderabad Division whereby he rejected the appeal of the petitioner and maintained the_order of the Colonization Officer, Sukkur Barrage, Hyderabad in respect of S. No, 109/3 area 11-30 acres of del: Kari Taluka Tando Muhammad Khan.
2. Heard the counsel for the parties, perused the impugned order as well as record produced by the Tapedar.
3. The counsel for the petitioner reiterated the same arguments which have already been thoroughly discussed in the impugned order of the Additional Commissioner, Hyderabad Division.
No new point has been advanced by the counsel for the petitioner to rebut the findings contained in the impugned order. It is revealed from the impugned order that the petitioner has neither applied for the dispute land at original level nor contested in the Katchery, hence he has no cause of action and hence the appeal before the Additional Commissioner and revision before this Court are not maintainable.
4. For the foregoing reasons, there is no justification for interference with the concurrent findings of the Additional Commissioner and the Colonization Officer. Sukkur Barrage, Hyderabad. The revision petition is therefore, rejected hereby. revisions by the competent authorities.
