ORDER

Jahan petitioner filed this application against Ghulam Muhammad under section 491, Cr. P. C. for recovery and release of his daughter Mst. Fateh Khatoon alias Fatti. He alleged that at first Mst. Fatti was abducted by Khuda Yar and that when he (petitioner) approached him for restoration, Khuda Yar informed him that she had been further abducted. Eventually the petitioner came to know that Mst. Fatti was being detained by the respondent against her will.

2. A Bailiff of this Court recovered Mst. Fatti from the house of the respondent in village Mitha Khuh and produced her in Court.

3. Ghulam Muhammad respondent claimed that Mst. Fatti was duly married to him and was living in his house freely as his wife. He admitted that she was more than 16 years old.

4. Mst. Fatti stated that she had at first been abducted by Khuda Yar and later had been detained by the respondent against her will. She denied that she was married to the respon dent. She expressed her desire to live with her father.

5. Mst, Fatti is sui juris. She wants to live with her father. She is set at liberty. She is permitted to live wherever she may please. If the respondent feels aggrieved, he may file a suit for restitution of conjugal rights and seek redress from a Family Court. . revisions by the competent authorities.
