' S. ABDUL JABBAR KHAN (CHAIRMAN).-- Lutufullah Khan Mazari has filed this appeal under section 4 of the Punjab Service Tribunals Act, 1974, in which he has impleaded the Solicitor to Government of the Punjab, Lahore as well as Secretary to Government of the Punjab, Law Department, Lahore as respondents.

2. By virtue of this appeal he has prayed that the adverse remarks against the appellant recorded in his A.C.R. For the period from 1-1-1977 to 20-6-1977, by Mr. Salahuddin Zafar the then Solicitor Punjab, be expunged.

3. We have heard the learned counsel for the appellant as well as learned District Attorney assisted by the representative of the Department and have taken into consideration the comments so filed by the respondents in this behalf.

4. On examination of the record it is revealed that the appellant was considered "Below average. An officer with little sense of duty. More interested in the postings nearer home than performing his duty". We have fully examined the comments of the Reporting Officer and find the same as fully justified. The fact of the matter is that the Reporting Officer found the appellant more interested in his posting nearer to his home than devotion to his work as Attorney. As the observations recorded against him are based on good reasons and hardly need any interference by this Tribunal.

5. In view of the above, we proceed to dismiss the appeal as being without any merit. There will be no order as to costs.
