1. ' The F.I.R in this case shows that the applicant is the brother-in-law of the complainant and was staying with him. He took out 12 bore country-made pistol from below his pillow, which was loaded with empty cartridge and while he was showing the same it fired and the pellets struck the applicant's sister-in-law Hawa, who was the wife of the complainant. Therefore, even from the F.I.R.
2. It appears to be prima facie case of a, rash-and ,negligent act which caused the death of Hawa by accident. Even the certified True copy of the challan presented today by Mr. Shafi shows that the applicant has been challaned under section 304-A, P.P.C.'
