' AJMAL MIAN, J.-The petitioners through this petition have impugned the order dated 18th December, 1976, whereby certain gifts made by petitioner No, 1 in favour of petitioners 2 to 6, his major and minor sons, have been held invalid inter alia on the ground that the above gifts were not effected prior to the target date and that there were certain manipulations in the revenue record.
The grievance of the petitioners apart from assailing the above order on merits was that they were not served with the notice prior to the passing of the impugned order. On merits, it has been contended by the petitioner that factually the above gifts were made prior to the target date and the conclusion arrived at by respondent No, I is not sustainable on the basis of evidence on record.
2. In our view it will be just and proper to remand the case to the Federal Land Commission with the direction to decide afresh after notice to the petitioners in accordance with law. . In the circumstances of the case there will be no order as to costs.
