' This writ petition is directed against the orders of Additional Settlement Commissioner (L), dated 9th December, 1970 and Settlement Commissioner (L), Lahore Division, dated 11th December, 1973.
2. It was maintained in the present petition that Mst. Sughra, a displaced person, submitted her claim form No, 5109 for the land abandoned by her in India and got allotted some of her P.I. Units in Village Talvandi Bajwa, Tehsil and District Sialkot ; that remaining 1005 P.I. Units of Mst. Sughra Begum were transferred from Village Talvandi Bajwa to Village Rooras and from there, to Village Mangoo Behram where land measuring 412 Kanals 5 Marlas was allotted to her and confirmed in her favour by the Deputy Settlement Commissioner (L), Sialkot, on 15th January, 1966 ; that land allotted to Mst. Sughra Begum was mutated in the name of her son Mubarak Ali after the death of Mst. Sughra : that Mubarak Ali sold the land to the petitioner and mutation was sanctioned in favour of the petitioner on 17th March, 1966 ; that petitioner invested huge sum over the development of land : that one Umar Din filed an appeal against the order of Deputy Settlement Commissioner (L), dated 15th January, 1966 but the appeal was dismissed ; that Umar Din filed revision petition, which was also dismissed on 17th November, 1969 ; that Bagh Ali filed a time- barred appeal against the order of Deputy Settlement Commissioner (L), dated 15th January, 1966 and his appeal was accepted on 9th December, 1970 without any notice to the petitioner ; that petitioner filed a revision petition which was dismissed by respondent No, 4 on 14th December, 1973.
It was alleged by the petitioner that both the orders passed by the Additional Settlement Commissioner (L) and Settlement Commissioner (L) were not in accordance with law.
3. The previous appeal and revision petition filed by Umar Din could have no bearing on the present case as both were not between the same parties. Mst. Sughra Begum was allotted land in Village Talvandi Bajwa against her claim forms Nos. 5109 & 5110. The land verified against the said claim forms came to 1846 P.T. Units. Mst. Sughra Begum had been confirmed land to the extent of 1847 P. I.
Units in Village Talvandi Bajwa. Her claim forms stood satisfied. She had no P.I. Units to be transferred to another Village. It stood proved from document R. 1 that Mst. Sughra Begum had been allotted land to the extent of 1847 P. I. Units against her claim forms Nos. 5109 and 5110 which were of 1846 P. I. Units. It was rightly held by the learned Additional Settlement Commissioner (L) and Settlement Commissioner (L) that the order of allotment of land in favour of Mst. Sughra Begum in village Mangoo Behram was a void order.
The present petitioner had been served by beat of drum but he did not appear before the Additional Settlement Commissioner (L), Sialkot, and ex parte order was passed.
4. For the reasons stated above, I see no force in this Writ Petition and dismiss it with costs.
